Welcome to Lesiba Social Solutions (Pty) Ltd ("we", "us", "our", "Lesiba Social Solutions"). These Terms of Use ("Terms") govern your access to and use of our website (www.lesibasocialsolutions.co.za), booking of counselling, consultancy sessions, workshops, and any related services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Services Description

We provide professional counselling, consultancy sessions (in-person or online), workshops, and related support services. Services may involve sensitive personal, health, or mental health information.

2. Eligibility

You must be at least 18 years old (or have guardian consent if under 18) to use our Services. By using the Services, you represent that you meet these requirements.

3. Bookings and Appointments

- All bookings are subject to availability and confirmation by us.

- You agree to provide accurate information during booking.

- Cancellations or rescheduling must be made at least 48 hours in advance, failing which cancellation fees may apply (see Refund Policy).

- We reserve the right to refuse or cancel any booking.

4. User Conduct

You agree not to:

- Use the Services for any unlawful purpose;

- Harass, abuse, or harm any person;

- Share or record sessions without our explicit written consent;

- Attempt to gain unauthorized access to our systems.

5. Confidentiality and Professional Obligations

We treat all client information in accordance with our Privacy Policy and applicable professional ethics. You acknowledge that sessions are confidential, subject to legal exceptions (e.g., mandatory reporting of harm to self or others).

6. Intellectual Property

All content on our website, materials provided during workshops/sessions (unless otherwise stated), and our branding are owned by us or licensed to us. You may not reproduce, distribute, or create derivative works without our written permission.

7. Limitation of Liability

To the fullest extent permitted by law:

- Services are provided "as is" without warranties of any kind;

- We are not liable for any indirect, incidental, consequential, or special damages arising from use of the Services;

- Our total liability shall not exceed the fees paid by you for the specific service giving rise to the claim.

Nothing in these Terms excludes liability for gross negligence, fraud, or where prohibited by the Consumer Protection Act.

8. Indemnity

You agree to indemnify and hold us harmless from any claims arising from your breach of these Terms or misuse of the Services.

9. Termination

We may suspend or terminate your access to Services at any time for breach of these Terms or for any other reason.

10. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts in Gauteng (or the appropriate court based on your location).

11. Changes to Terms

We may update these Terms from time to time. Continued use after changes constitutes acceptance.
